The short version: Use Missless fairly, pay your subscription, give us accurate addresses and we'll send beautiful cards on time.

1. About these terms

These Terms govern your use of Missless operated by Missless Pty Ltd. By signing up, you agree to these terms.

2. Our service

Missless designs, prints and posts physical greeting cards to recipients you nominate, on dates and occasions you specify. You are responsible for ensuring recipient details are accurate.

3. Subscriptions and payment

Subscriptions are billed monthly in AUD. Payment is processed by Stripe. You authorise recurring monthly charges. We give 30 days notice of any price increases.

Failed payments

If payment fails, we will attempt to collect again. Your subscription may be suspended if payment cannot be collected. We will notify you by email.

4. Cancellation

Cancel any time via your account or by emailing hello@missless.com.au. Cancellation takes effect at the end of the current billing period. No partial refunds except as required by Australian Consumer Law.

5. Card rollover and anniversary reset

Unused cards accumulate month to month on all plans (Essential, Value and Family) and may be used at any time during your subscription year. Your card balance resets to zero on the anniversary of your original signup date each year.

We will send you a reminder email 30 days before your anniversary date so you have time to schedule any remaining cards before they expire. Any balance remaining on your anniversary date is forfeited and has no monetary value.

On cancellation of your subscription, any accumulated card balance expires immediately and is not refundable, except where required by Australian Consumer Law.

6. Extra cards and plan overages

If you exhaust your accumulated card balance and have additional occasions in a given month, we will notify you by email and offer two options:

We will never send an extra card and charge you without your explicit confirmation first. If you do not respond within 48 hours we will hold the card and notify you of the delay.

7. Card delivery

We make every effort to post cards with sufficient time to arrive before your occasion. We cannot guarantee delivery dates due to postal service delays outside our control. We recommend providing occasion details at least 4 weeks before the date.

8. Accuracy of information

You are responsible for providing accurate recipient names, addresses and occasion dates. We are not liable for delivery failures due to inaccurate information.

9. Acceptable use

By using Missless, you agree that you will only send cards to recipients who would reasonably welcome receiving them. You must not use our service to harass, intimidate, stalk or cause distress to any person.

10. Consent and recipient welfare

You represent and warrant that:

If a recipient contacts us to report unwanted cards, we reserve the right to immediately suspend your account and cancel all pending orders without refund. We take recipient welfare seriously and will act on all such reports promptly.

11. Prohibited content and conduct

You must not use Missless to send cards that contain or relate to:

We reserve the right to review card messages where we have reasonable cause for concern, refuse any order, and cancel any account used in breach of these terms. No refund will be issued where an account is terminated for breach of this section.

Where we have reasonable grounds to believe our service has been used to facilitate harassment, abuse or stalking, we will cooperate fully with relevant law enforcement authorities.

12. Limitation of liability

To the maximum extent permitted by Australian law, our total liability shall not exceed the amount paid by you in the 3 months prior to the claim. Nothing limits your rights under the Australian Consumer Law.

13. Governing law

These terms are governed by the laws of Victoria, Australia.
